Promise Serves Terms of Service

PLEASE READ THESE TERMS OF USE ("AGREEMENT") CAREFULLY BEFORE USING THE SERVICES OFFERED BY PROMISE686. BY ACCESSING OR USING PROMISE SERVES IN ANY MANNER, YOU AGREE THAT YOU HAVE READ AND AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT TO THE EXCLUSION OF ALL OTHER TERMS. IF YOU DO NOT UNCONDITIONALLY AGREE TO ALL THE TERMS AND CONDITIONS OF THE AGREEMENT, YOU MAY NOT USE THE SERVICES.

Welcome to Promise Serves. Promise Serves is a Volunteer Management System that helps church communities coordinate volunteer support for foster families. Please continue reading to learn about the rules and restrictions that govern your use of Promise Serves and other services made available by Promise686.  

Additional terms

This Agreement applies to all users of Promise Serves, but there are special terms for you depending on what type of user you are.

Volunteers, for example, are invited by churches and church advocates to participant on teams that support foster families.  Volunteers have the ability to create and manage their own contact data within Promise Serves. Church Advocates have been trained by a Promise686 Affiliate and have the ability to search for Promise Serves for volunteers, add Foster Families into the system, and build teams of volunteers to support Foster Families.  If you are Affiliate Staff you are a staff member of a Promise686 partnering affiliate that has the ability to manage churches and agencies, as well as their teams of advocates and volunteers.  If you are an Affiliate Administrator, you have system administrator permission for your affiliate’s domain within Promise Serves.

If you are accessing Promise Serves as a Volunteer:

• You are responsible for maintaining the truthful accuracy of the information relating to your Promise Serves User Account.
• You agree to never share your password.
• You agree to avoid posting or sending any inappropriate content.
• The Affiliate, Church Advocates, and Team Leaders may be able to view information including contact information, interests, and involvement on Care Communities.

If you are accessing Promise Serves as an Advocate:

• When utilizing Promise Serves, you agree to never use any of the contact information for any purpose outside of growing and sustaining the FAM at my church. When using the geo-location feature, which identifies available volunteers outside your church, you will first contact the Advocate of that church before initiating contact with the volunteer. You agree that other Advocates may contact you utilizing you listed email address.
• Use of the LTP Advocate portal is exclusively for trained Advocates who have attended an LTP Clinic. You agree to not share your password with anyone or download or share the materials, including the Advocate Handbook, for anything other than the ministry at your church without permission from Promise686.
• You understand that Live The Promise is a network of churches and will strive to collaborate with local partner churches as often as possible.
• You will communicate with your church leadership and Promise686 or the Affiliate in your state in a timely manner if you decide you can no longer be a part of the Advocate Team at your church.
• You understand that an Advocate Team of two or more trained members is ideal for long-term success of the FAM and will strive to have a team in place.
• You may create Events, Volunteer Teams, and Foster Family records, and assist Volunteers with managing their User Accounts.

If you are Accessing Promise Serves as an Affiliate Staff:

• You are responsible for maintaining the accuracy of the information relating to your Organization and your partner Organizations (ie, Agencies, Churches, etc.).
• Invite and add Advocates and Volunteers to Promise Serves,
• View and manage users and information affiliated with your Organization,
• Add and Edit Advocates, Organizations (ie, Agencies, Churches, etc.), Teams, and Volunteers affiliated with your Organization,
• Communicate directly with other users affiliated with your Organization,
• View contact information, which will include personally identifiable information, of all Serves users connected with your Organization, as appropriate.
• If at any time you learn that a user of Promise Serves claims to be affiliated with your organization but is not, or that a user within your Affiliate’s Domain has violated the Terms of User, you will immediately report the violation to your Affiliate Administrator. take immediate corrective action, up to locking that user’s account, and notify Promise686.

If Promise686 verifies you as an Affiliate Administrator of your Organization, you may have the ability to perform the following tasks:

• Add and manage Affiliate Staff to Promise Serves.
• Add and Edit Advocates, Organizations (ie, Agencies, Churches, etc.), Teams, and Volunteers affiliated within your Affiliate Domain.
• Re-Brand certain elements of your Promise Serves Domain.
• Append Terms of Use within your domain to add additional conditions as needed.  You may not void any Terms of Use from this agreement, but may add additional Terms of Use that do not violate your local, state, or federal laws.
• Suspend or terminate accounts for violation of conditions.
• Connect and upload or sync information relating to Advocates, Oragnizations, Volunteers, Care Communities, and Foster Families using a data upload or syncing mechanism (such as, using CSV upload).
• If at any time you learn that a user of Promise Serves claims to be affiliated with your organization but is not, or that a user within your Affiliate’s Domain has violated the Terms of User, you will take immediate corrective action, up to locking that user’s account, and notify Promise686.

IF YOU CHOOSE TO DO ANY OF THE ABOVE, YOU REPRESENT AND WARRANT THAT YOU HAVE ALL RIGHTS AND HAVE OBTAINED ALL CONSENTS AND AUTHORIZATIONS NECESSARY TO PERFORM SUCH TASKS AND THAT YOU WILL ONLY USE PERSONAL INFORMATION IN ACCORDANCE WITH APPLICABLE PRIVACY LAWS. Promise686 may use the information you upload to Promise Serves in order to help us demonstrate the impact and effectiveness of the Live The Promise model and to provide you with the Services.

A. Your Accounts

 In order to use and access Promise Serves, you will be required to create an account and specify a password.   To create an account, you must be at least 18 years old and you must provide truthful and accurate information about yourself.  If your information changes at any time, please update your account to reflect those changes.

In some cases, an account may be assigned to you by an Affiliate Administrator, Affiliate Staff, or Church Advocate.  Additionally, your administrator may be able to access or disable your account without our involvement.

You should not share your account with anyone else. Please keep your password confidential.  If you believe that your account has been compromised at any time, please notify your system administrator.

B. Promise Serves Community

The personal information (such as name, company information, photos etc.) that may be collected during the course of registration or use of Serves may be used or shared with our partners for the purpose of improving quality of our services.  Your first name and last name may be displayed on your Serves account, which is visible to other users of Promise Serves. Your Serves account is for your use only and should not be shared or used by anyone else. You are solely responsible for maintaining the confidentiality of your Serves username and password, and are entirely responsible for any and all activities under your Serves account. You agree to notify your immediate affiliate and / or Promise686 immediately of any unauthorized use or any other breach of security involving your username and password or account. Promise686 will not be liable for any loss incurred as a result of an unauthorized use of a username/password or account.

You acknowledge and agree that Promise Serves is a public space and that your participation in Promise Serves creates no expectation of privacy. Further, you acknowledge that any Content that you create may be seen and used by others.  IF YOU CHOOSE TO MAKE ANY OF YOUR PERSONAL INFORMATION OR OTHER CONTENT PUBLICLY AVAILABLE IN PROMISE SERVES, YOU DO SO AT YOUR OWN RISK.

C. Modifications and Termination

We reserve the right to modify Serves at any time, with or without notice to you. For example, we may add or remove functionality or features, and we may suspend or stop a particular feature altogether.  If you do not agree to the changes, you should stop using or logging in to the Serves. By continuing to use or log in to Serves after these Terms have changed, you indicate your agreement to the revised Terms.

If you do not comply with these Terms, and we don’t take action right away, this doesn’t mean we’re OK with what you did, or we are giving up any rights that we may have (such as taking action in the future).

D. Content You Post

We may provide opportunities for you to post text, photographs, videos, or other content (collectively, “Content”) on the Serves. You can only post Content if you own all the rights to that Content, or if another rights holder has given you permission.

You agree to indemnify, release, and hold Promise686 harmless from any all liability, claims, actions, loss, harm, damage, injury, cost or expense arising out of any Content you post.

E. Content Posted by Others

Promise686 is not responsible for, and does not endorse, Content posted by any other person. Accordingly, Promise686 may not be held liable, directly or indirectly, for any loss or damage caused to you in connection with any Content posted by another member.

F. Your Use of Promise Serves

Please do not use the Promise Serves in a way that violates any laws, infringes on anyone’s rights, is offensive, or interferes with the Serves Community or any features on the site (including any technological measures we employ to enforce these Terms).

If Promise686 or Affiliate Partner determines that you have acted inappropriately, we reserve the right to take down Content, terminate your account, and prohibit you from using Promise Serves.

Using Promise Serves does not give you ownership of any intellectual property rights to the content you access. You may not use content from Promise Serves unless you obtain permission from us or its owner.

When you use or send communications through Promise Serves, you are communicating with us electronically. You consent to receive electronically any communications related to your use of Promise Serves. We may communicate with you by email or by posting notices on Promise Serves. You agree that all agreements, notices, disclosures and other communications that are provided to you electronically satisfy any legal requirement that such communications be in writing.  Please note that by submitting Content, creating a user account or otherwise providing us with your email address, postal address or phone number, you are agreeing that we or our agents may contact you at that address or number.

J. Liability for our Services

EXCEPT WHERE PROHIBITED, THE SERVICES ENTITIES SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF SERVES OR ANY THIRD PARTY’S USE OF THE SITES. THESE EXCLUSIONS INCLUDE, WITHOUT LIMITATION, LOST DATA, COMPUTER FAILURE, OR THE VIOLATION OF YOUR RIGHTS BY ANY THIRD PARTY, EVEN IF THE SERVICES ENTITIES HAVE BEEN ADVISED OF THE POSSIBILITY THEREOF AND REGARDLESS OF THE LEGAL OR EQUITABLE THEORY UPON WHICH THE CLAIM IS BASED.
